mEinstein Acceptable Use Policy (AUP)

This Acceptable Use Policy ("Policy") describes the rules that apply to your access to and use of the mEinstein application, related websites, associated products, features, content, marketplaces, and services (collectively, the "Services") provided by mEinstein AI, Inc. and its affiliates ("mEinstein," "we," "us," or "our"). This Policy should be read together with our Terms and Conditions, Privacy Policy, Responsible Data and Marketplace Ethics Guideline, Marketplace Dispute and Resolution Policy, Marketplace Refund Policy, Account Deletion and Data Removal Policy, and any feature-specific disclosures, provider terms, or transaction terms that apply to particular functionality.

This Policy is intended to protect users, the Services, service providers, and the integrity of the mEinstein platform. It is written for an AI, marketplace, payments, and connected-data environment. It does not grant any right to use the Services for any purpose that is unlawful, harmful, deceptive, abusive, or inconsistent with the governing documents or applicable law.

1. Purpose and Scope

This Policy applies to all users, buyers, sellers, visitors, connected-service participants, and other parties who access or use the Services.

It applies to conduct on or through the Services, including platform-connected workflows, integrated providers, and any data, content, transactions, payouts, payments, support requests, dispute submissions, deletion requests, certifications, or AI-assisted features made available through the Services.

If there is a conflict, the applicable feature-specific disclosures, transaction terms, Terms and Conditions, Privacy Policy, and applicable law will govern in that order, unless a different order is expressly stated.

2. General Rule of Lawful and Responsible Use

You may use the Services only for lawful, authorized, and responsible purposes, and only in a manner consistent with this Policy, the governing documents, the rights of others, and applicable law.

You are responsible for your conduct, your account, your device security, the content or data you submit, the transactions you initiate or authorize, and your use of any outputs, records, or marketplace activity obtained through the Services.

3. Prohibited Conduct

You must not use the Services to engage in or facilitate any illegal, fraudulent, deceptive, abusive, harmful, or exploitative conduct.

Without limitation, you may not:

  1. violate any applicable law, regulation, court order, sanctions restriction, export-control rule, or third-party right.
  2. harass, threaten, stalk, bully, defame, impersonate, intimidate, or otherwise harm another person or organization.
  3. submit false, misleading, forged, manipulated, or fraudulent information, records, certifications, evidence, credentials, or transaction details.
  4. use the Services in a manner that is deceptive, unfair, abusive, or likely to create unreasonable risk or harm to individuals, groups, providers, or the platform.
  5. use the Services to facilitate money laundering, fraud, tax evasion, sanctions evasion, unlawful discrimination, unlawful surveillance, stalking, doxxing, or other prohibited conduct.
  6. attempt to exploit, probe, scan, bypass, disable, or interfere with safety controls, permissions, rate limits, security measures, provider controls, or technical restrictions applicable to the Services.
  7. interfere with the normal operation, availability, performance, or integrity of the Services or of any connected provider workflow. or
  8. encourage, instruct, or help another person to do any of the foregoing.

4. Prohibited Content and Data Practices

You must not upload, transmit, create, list, submit, or otherwise make available through the Services any content, data, or material that:

  1. is unlawful, infringing, fraudulent, hateful, violent, threatening, obscene, exploitative, or invasive of another person's rights.
  2. contains malware, spyware, ransomware, malicious code, harmful scripts, or other destructive or unauthorized functionality.
  3. includes direct identifiers, sensitive information, or prohibited content in a context where the relevant feature, consent flow, or transaction terms do not permit it.
  4. you do not have the legal right or authorization to use, share, transfer, list, sell, or process;
  5. is materially false, misleading, or improperly labeled as anonymous, anonymized, de-identified, or nonpersonal when that characterization is inaccurate. or
  6. is submitted in a manner intended to bypass feature restrictions, transformation requirements, content controls, consent requirements, or policy safeguards.

5. Marketplace, Data, and AI Misuse Restrictions

Because the Services may include marketplace, connected-data, and AI-assisted features, the following restrictions apply in addition to any feature-specific terms:

  1. You must not attempt to identify, single out, infer, reconstruct, merge, enrich, link, or re-identify individuals from marketplace data, transformed data, derived outputs, or transaction records except where explicitly authorized by law and the governing transaction terms.
  2. You must not use marketplace data or derived outputs for unlawful profiling, discriminatory scoring, unlawful surveillance, prohibited targeting, manipulation, harassment, or other harmful or impermissible decision-making uses.
  3. You must not resell, redistribute, sublicense, disclose, or otherwise use marketplace data or outputs beyond the scope permitted by the applicable transaction terms, permissions, and law.
  4. You must not misuse AI Conversation, Assist, or other AI features to generate, transmit, or operationalize unlawful content, harmful content, fraudulent content, or content intended to circumvent legal, contractual, safety, or provider controls.
  5. You must not submit prompts, context, data, or instructions that you are not authorized to use, disclose, or process through the relevant AI or platform workflow.
  6. You must not use the Services to train competing models on platform content, systematically extract outputs, scrape data, or otherwise exploit the Services or their underlying systems beyond the permissions granted in the Terms and Conditions.
  7. You must not attempt to circumvent transaction limits, consent boundaries, provider restrictions, or feature-specific safeguards applicable to marketplace, connected-data, or AI functionality.

6. Payments, Payouts, Refunds, Disputes, and Certifications

You must not misuse payment, payout, dispute, refund, deletion, consent, verification, certification, or support workflows.

Without limitation, you must not:

  1. Submit false or bad-faith refund requests, disputes, deletion requests, evidence, certifications, or confirmations.
  2. Attempt to manipulate, game, or misuse payout timing, settlement logic, dispute timing, transaction review flows, or provider verification requirements.
  3. Attempt to conceal, misrepresent, reroute, or improperly obtain funds, payouts, credits, reversals, or other payment outcomes.
  4. use another person's financial account, payout details, identity, credentials, or payment method without authorization. or
  5. Interfere with or evade provider-side fraud, compliance, tax, banking, identity-verification, settlement, or recordkeeping requirements.

7. Security and Platform Integrity

You must maintain appropriate security over your own account, credentials, devices, and connected services.

You must not attempt unauthorized access to any account, system, dataset, provider integration, or network associated with the Services, whether by phishing, credential theft, password attacks, token misuse, reverse engineering, scraping, API abuse, or any similar method.

If you discover a vulnerability or security issue, you must not exploit it. You should report it promptly through authorized support or security channels.

mEinstein may preserve logs, records, or other evidence relating to suspected security or policy violations for legal, security, fraud-prevention, audit, or dispute-resolution purposes.

8. No High-Risk or Unauthorized Reliance

You must not use the Services in any way that violates the Terms and Conditions' restrictions on high-risk or regulated uses, including emergency, life-critical, or unlawful uses.

You remain responsible for evaluating outputs, transaction data, connected-data insights, and other information obtained through the Services before relying on them.

9. Reporting and Cooperation

You should report suspected violations, abuse, fraud, security issues, harmful content, or policy breaches through the support, dispute, or reporting channels made available by mEinstein.

You must cooperate in good faith with reasonable requests for information, clarification, certification, remediation, or technical cooperation relating to safety, compliance, fraud prevention, dispute handling, provider requirements, or policy enforcement.

Failure to cooperate may result in content removal, listing removal, payout hold, feature restriction, suspension, termination, or other enforcement action.

10. Enforcement and Platform Action

mEinstein may investigate suspected violations of this Policy, the Terms and Conditions, the Privacy Policy, the Responsible Data and Marketplace Ethics Guideline, the Marketplace Dispute and Resolution Policy, the Marketplace Refund Policy, provider rules, transaction terms, or applicable law.

Where reasonably necessary, mEinstein may issue warnings, remove content or listings, reject submissions, place transaction or payout holds, restrict features, refuse marketplace activity, suspend or terminate access, preserve records or evidence, notify affected parties or providers, and refer matters to law enforcement, regulators, or other authorities where appropriate.

Nothing in this Policy obligates mEinstein to permit, continue, approve, or restore any user account, listing, transaction, payout, provider integration, feature, content item, or requested outcome.

mEinstein may act immediately and without prior notice where reasonably necessary for security, safety, fraud prevention, legal compliance, provider requirements, or platform integrity.

11. Relationship to Other Documents

This Policy supplements, and should be read together with, the Terms and Conditions, Privacy Policy, Responsible Data and Marketplace Ethics Guideline, Marketplace Dispute and Resolution Policy, Marketplace Refund Policy, Account Deletion and Data Removal Policy, and any applicable feature-specific disclosures, provider terms, or transaction terms.

Nothing in this Policy limits any rights or remedies mEinstein may have under those documents or under applicable law.

This Policy is governed by and should be interpreted consistently with the governing-law and disputeresolution provisions in the Terms and Conditions.

12. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we may provide notice through the app, by email, on our website, or by other reasonable means. Unless otherwise required by law, an updated Policy will become effective when posted or on the effective date stated in the updated Policy. Continued use of the Services after the effective date constitutes acceptance of the updated Policy.

Any provisions of this Policy that by their nature should survive suspension, termination, dispute closure, payout hold, transaction cancellation, account deletion, or the end of a marketplace relationship will survive to the extent permitted by law.
